In divorce, property division is typically one of the most contentious processes. Despite the financial value of the assets you own, Raggio & Raggio, PLLC is committed to helping you protect what matters most to you in your divorce.
Helping Our Clients Understand Texas Community And Separate Property Laws
Since 1956, our leading Dallas family law firm has represented men and women throughout the Dallas area in simple and complex divorce cases involving property division. Often, our clients come to us without a clear understanding of the state laws surrounding property division.
There are two major categories of property in the state of Texas: community property and separate property. The community property is to be divided in a divorce in a fair and equitable manner — not necessarily equally.
Separate property is considered property owned prior to marriage, property acquired at any time by gift or inheritance and recoveries for personal injuries sustained by a spouse during marriage (except for loss of earnings).
There is a presumption that all property possessed by either spouse is community property. Separate property ownership must be proven by clear and convincing evidence.
Community property consists of the property, other than separate property, acquired by either spouse during marriage, including:
- Homes
- Vacation property
- Time shares
- Other real estate
- Vehicles
- Businesses
- Investments and retirement accounts
- Bank accounts
- Valuable personal property (antiques, artwork, etc.)
- Pensions (government pensions, military pensions, etc.)
Just because one spouse is named on the title, deed or account or receives the asset as payment for personal services (i.e., salary) now or in the future (i.e., retirement funds), does not make it separate property.
Our Dallas property division lawyers will help you provide proof of your separate property, as well as address concerns involving commingled property. Through effective use of state-of-the-art technology, Raggio & Raggio, PLLC handles financially complex cases requiring extensive research and analysis, including cases involving tracing of marital assets, reimbursement and disproportionate division.
We recognize the important interests at hand. Drawing from decades of legal experience helping clients obtain satisfying property division results, our attorneys are fully prepared to help you today.
