Texas informal marriage laws state that two people can be considered in a common law marriage by meeting the following requirements:
- Both individuals agreed to be currently married at some point
- Both individuals lived with each other in Texas at that point
- Both individuals live and act as though they are husband and wife (i.e., publicly introduce each other as spouses, file joint tax returns, etc.)
Common Law Divorce
Unlike in a divorce proceeding for Texas formal marriages, there are strict time limits that govern certain rights individuals are able to take advantage of in asserting a common law marriage.
For instance, if you and your common law spouse stop living with each other for more than two years, your common law marriage will be considered by Texas law to have never existed. This means any protection the law would have afforded you during your division of assets would no longer be available.
