Court Suspends Dad’s Duty to Pay Child Support
A New York Appellate Court approves a Trial Court’s suspending of the Father’s duty to pay child support because the Mother absolutely refused to allow the child to have Court-Ordered contact with the Father, and stated that she would not budge in her position. (Kinda sounds like the County Clerk in Kentucky talking about same sex marriage licenses…)
So the Court suspended the Father’s duty to pay about $1900 per month in child support.
This is against the normal rule that visitation and child support are independent rights and duties; a violation of orders on one doesn’t authorize or excuse a violation of the other.
